Terms of Service

Welcome to Luna Wishlist. These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "user") and Luna Wishlist LLC ("Luna Wishlist", "we", "us", or "our"), governing your access to and use of our mobile applications, website at lunawishlist.com, and any related services (collectively, the "Services").

By downloading, installing, registering, or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not access or use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Services, you represent and warrant that you meet these eligibility requirements.

The Services are not available to users previously suspended or removed by Luna Wishlist, or to persons who are barred from receiving services under applicable law.

2. Account Registration

Certain features of the Services require you to create an account via Firebase Authentication. When registering you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Not share your account or allow others to access it.
• Notify us immediately at contactus@lunawishlist.com if you suspect unauthorized access to your account.

You are solely responsible for all activity that occurs under your account. Luna Wishlist is not liable for any loss resulting from unauthorized use of your account credentials.

3. License to Use the Services

Subject to your compliance with these Terms, Luna Wishlist grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Download and install the app on devices you own or control.
• Access and use the Services for your personal, non-commercial purposes.

This license does not include the right to: resell or commercially exploit the Services; copy, modify, distribute, or create derivative works; reverse engineer, decompile, or disassemble any part of the Services; or use the Services to build a competing product or service.

4. User Content

4.1 Your Content

"User Content" means any data, text, images, lists, goals, or other materials you create, submit, store, or share through the Services. You retain full ownership of your User Content.

4.2 License You Grant Us

By submitting User Content, you grant Luna Wishlist a worldwide, non-exclusive, royalty-free, sublicensable license to store, display, reproduce, and process your User Content solely to the extent necessary to provide and improve the Services (including via Google Firebase Firestore and Storage).

4.3 Your Responsibilities

You represent and warrant that your User Content:

• Does not infringe any copyright, trademark, trade secret, patent, or other intellectual property right.
• Does not violate any applicable law or regulation.
• Does not contain viruses, malware, or other harmful code.
• Does not contain defamatory, obscene, harassing, or otherwise objectionable material.

5. Acceptable Use

You agree not to use the Services to:

• Violate any applicable local, state, national, or international law or regulation.
• Transmit unsolicited or unauthorized advertising, spam, or chain messages.
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
• Collect or harvest personal information about other users without consent.
• Attempt to probe, scan, or test the vulnerability of the Services or any related system.
• Interfere with or disrupt the integrity or performance of the Services or underlying infrastructure.
• Bypass any security mechanisms, rate limits, or access controls.
• Use automated scripts, bots, scrapers, or similar tools to access or interact with the Services.
• Facilitate or encourage any of the above activities.

Violation of this section may result in immediate suspension or termination of your account and access to the Services.

6. Advertisements

The Services display advertisements served by Google AdMob, which is our primary source of revenue. By using the Services, you acknowledge and consent to:

• Receiving ads within the app, including banner, native, interstitial, and other ad formats we may enable.
• AdMob's collection and use of advertising identifiers and related data to serve and measure ads.
• Ad frequency and placement changes at our discretion without prior notice.

You may opt out of personalized advertising as described in our Privacy Policy.

7. Rewards Programs

Some Services may include points, loyalty, or rewards features. VocabHack may allow eligible users to earn non-purchasable points through in-app educational activities. HealthyFuture may allow eligible users to earn non-purchasable points through in-app healthy habit activities. RichHabits may allow eligible users to earn non-purchasable points through in-app wealth-building habit activities. In each case, earned points may be redeemed for available rewards subject to the rules below.

• No purchase necessary: Points are earned only through eligible in-app activity unless we expressly state otherwise in a specific program.
• Non-purchasable points: Points are not sold, purchased, exchanged for money, or treated as stored value.
• Expiration for inactivity: Points may expire if your account has no point-earning or point-redemption activity for 12 consecutive months, subject to applicable law.
• Fixed thresholds: Rewards, if available, are redeemed at fixed published thresholds shown in the applicable app.
• Eligibility rules: Rewards may be limited by geography, account status, account age, verified contact information, inventory, partner availability, and other published requirements.
• United States limitation: For VocabHack, HealthyFuture, and RichHabits, production reward redemption is currently available only to eligible users located in the United States.
• Review and approval: Reward requests may be reviewed for fraud, abuse, eligibility, policy compliance, and security before fulfillment.
• Denial or reversal: We may delay, deny, reverse, cancel, or withhold points or rewards obtained through abuse, manipulation, automation, duplicate accounts, policy violations, suspected fraud, or other prohibited conduct.
• No cash value: Except where required by law, points and rewards have no cash value, are non-transferable, and may not be resold or exchanged.
• Fulfillment providers: We may use third-party providers, including Tremendous, to fulfill rewards. Third-party provider terms and availability may apply.
• No chance-based prize mechanics: Unless expressly disclosed for a lawful and approved promotion, our app reward programs are not gambling, betting, lotteries, raffles, sweepstakes, or random chance prize systems.
• Program changes: We may modify, suspend, or terminate any reward program, earning rules, thresholds, or available rewards at any time, subject to applicable law.

Reward display screens, balances, redemption history, and success states may include demo or review-only experiences in testing or platform review environments. Those experiences do not guarantee real-world fulfillment outside the applicable production program rules.

8. Intellectual Property

The Services and all content within them — including but not limited to the app design, code, graphics, logos, icons, text, and product names — are owned by Luna Wishlist LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right to use the Luna Wishlist name, logo, or trademarks without our prior written permission. All rights not expressly granted are reserved.

9. Third-Party Services and Links

The Services integrate with and depend on third-party services including:

• Google Firebase — authentication, database, storage, analytics, and crash reporting.
• Google AdMob — in-app advertising.
• Tremendous — reward fulfillment for eligible rewards where available.
• Apple App Store / Google Play Store — app distribution and in-app purchases (if applicable).

These third-party services are governed by their own terms and privacy policies. Luna Wishlist is not responsible for the practices or content of third-party services. Your use of any third-party service is at your own risk.

10. Fees and Payments

The core Services are currently available free of charge, supported by advertising. If we introduce paid features, subscriptions, or in-app purchases in the future, we will notify you in advance and applicable fees will be clearly disclosed before any purchase. All payments are processed through the relevant app store platform under their billing terms.

All purchases are final. Refunds are subject to the refund policy of the applicable app store (Apple App Store or Google Play Store).

11. Termination

By you: You may stop using the Services and delete your account at any time from within the app settings or by contacting us at contactus@lunawishlist.com.

By us: We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to violation of these Terms, suspected fraud, or extended inactivity.

Upon termination, your license to use the Services immediately ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

12. Disclaimers and Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LUNA WISHLIST DOES NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of implied warranties; in such cases the above exclusions apply to the maximum extent permitted by law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LUNA WISHLIST LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN NO EVENT WILL LUNA WISHLIST'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LUNA WISHLIST IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Luna Wishlist LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction in those courts.

Notwithstanding the above, Luna Wishlist may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you via in-app notice or email. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.

17. General Provisions

• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Luna Wishlist regarding the Services.
• Severability: If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• No agency: Nothing in these Terms creates any agency, partnership, or joint venture between you and Luna Wishlist.
